PPEC Licensing Requirements: AHCA Step-by-Step Guide

Obtaining a PPEC license from the Florida Agency for Health Care Administration (AHCA) is a multi-step process that typically takes six to twelve months from start to finish. Every step must be completed correctly; a single deficiency in your application or facility can delay your opening by months. This guide walks you through the entire process.

Step 1: Form Your Business Entity

Before you can apply for a PPEC license, you must establish a legal business entity registered with the Florida Division of Corporations. Most PPEC centers operate as a Limited Liability Company (LLC) or corporation. Your entity formation documents must clearly identify all owners, managing members, and officers. AHCA will cross-reference this information against background screening results, so accuracy is critical.

Step 2: Complete the AHCA License Application

Submit the AHCA initial licensure application, which is currently based on Form 3100-0009 (Health Care Clinic Licensure Application). The application requires detailed information including your facility address, ownership structure, proposed services, and administrator credentials. The application fee is approximately $2,765, though fees are subject to change. Applications can be submitted through AHCA's online portal or by mail.

Step 3: Background Screening (Level 2)

All owners, operators, managing employees, and board members must complete Level 2 background screening through the AHCA Clearinghouse. This involves LiveScan fingerprinting with checks against both the Florida Department of Law Enforcement (FDLE) and FBI databases. Any disqualifying offense listed in Section 435.04, Florida Statutes, will prevent licensure. It is strongly advisable to complete background screening early in the process so that any issues can be identified and addressed before the rest of the application is finalized.

Step 4: Submit Your Policies and Procedures Manual

AHCA requires a comprehensive policies and procedures manual covering every aspect of PPEC operations. Your manual must address:

  • Admission and discharge criteria
  • Plan of care development and review
  • Medication management and administration
  • Infection control protocols
  • Emergency preparedness (fire, weather, medical)
  • Child abuse and neglect reporting
  • Staffing plans and nurse-to-child ratios
  • Incident reporting and documentation
  • Quality assurance program
  • Transportation policies (if applicable)

The manual is reviewed by AHCA as part of the application process and will be examined again during the initial on-site survey. Inconsistencies between your written policies and actual operations are a common citation.

Step 5: Fire Marshal Inspection

Your facility must pass a fire safety inspection conducted by the local fire marshal or State Fire Marshal's office. The inspection verifies that the building meets fire code requirements including fire suppression systems (sprinklers), fire alarm systems, emergency lighting, exit signage, appropriate egress routes, and fire extinguisher placement. Many PPEC operators schedule this inspection during the buildout phase so that any deficiencies can be corrected by the contractor before occupancy.

Step 6: Zoning Approval

Your chosen location must be properly zoned for a medical or health care facility. Contact your local municipal or county zoning department to confirm the property's zoning classification. Some locations will require a conditional use permit or special exception. Zoning approval can take weeks to months depending on your jurisdiction, so begin this process as early as possible. You will need to provide proof of zoning compliance to AHCA.

Step 7: AHCA Initial Survey

Once your application is complete and AHCA has reviewed all documentation, they will schedule an initial licensure survey. During this unannounced or scheduled visit, AHCA surveyors will inspect your physical facility, review policies and procedures, verify staffing credentials, examine equipment, and confirm that the center is ready to receive children safely. Common areas of focus include:

  • Physical plant safety and cleanliness
  • Emergency equipment availability and functionality
  • Staff credential files and training documentation
  • Medication storage and management systems
  • Child-safe environment (outlet covers, secured cabinets, etc.)

If deficiencies are found, you will receive a Statement of Deficiencies and must submit a corrective action plan. A follow-up survey may be required before your license is issued.

Step 8: License Issuance

Upon passing the initial survey, AHCA will issue your PPEC license. The license is valid for two years and must be renewed before expiration. Display your license prominently in the facility as required by law. After licensure, you can begin Medicaid enrollment, contract with managed care organizations, and start accepting children.

Moratorium Status

As of 2026, there is no active moratorium on new PPEC licenses in Florida. However, moratoriums have been imposed in the past, so aspiring operators should verify current status with AHCA before beginning the application process. When a moratorium is in effect, no new applications are accepted regardless of readiness.

Timeline Summary

The entire process from entity formation to doors open typically spans 6 to 12 months. The most common delays occur during zoning approval, facility buildout, and the AHCA survey scheduling process.
